1. Acceptance of Terms
By accessing or using the BitirFood mobile application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service.
2. Description of Service
BitirFood is a food rescue marketplace that connects consumers ("Users") with local restaurants, bakeries, cafes, and other food businesses ("Business Partners") to purchase surplus food at discounted prices through "Surprise Packages."
BitirFood acts as an intermediary platform. We do not prepare, cook, or handle food. The Business Partners are solely responsible for the quality, safety, and content of the food they offer.
3. User Accounts
3.1 Registration
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.
3.2 Account Security
You are responsible for safeguarding your password and for all activities under your account. You must notify us immediately of any unauthorized use at support@bitirfood.com.
3.3 Account Types
The Service offers different account types: Consumer accounts for purchasing surprise packages, and Business accounts for listing and managing food packages.
4. Surprise Packages
4.1 Nature of Packages
Surprise Packages contain surplus food from Business Partners. The exact contents may vary and are at the discretion of the Business Partner. Users acknowledge the "surprise" nature of these packages when placing an order.
4.2 Pricing
Prices are set by Business Partners and displayed in the app. All prices include applicable taxes. Discounted prices represent savings compared to the original retail price of the included items.
4.3 Pickup
Users must pick up their packages during the designated pickup window. A unique 4-digit pickup code is provided for each order. Failure to pick up within the window may result in order cancellation without refund.
5. Payments
5.1 Payment Processing
All payments are processed securely through Stripe, our third-party payment processor. By making a purchase, you agree to Stripe's terms of service. BitirFood does not store your full credit card information.
5.2 Coupons and Discounts
BitirFood may offer coupons or promotional discounts. These are subject to specific terms and conditions, including expiration dates and usage limits.
6. Business Partner Responsibilities
Business Partners agree to:
- Comply with all local food safety regulations and hygiene standards
- Accurately describe the nature and category of their surprise packages
- Maintain appropriate food handling and storage practices
- Honor confirmed orders and provide food during the designated pickup window
- Maintain accurate business hours and contact information
7. User Conduct
Users agree not to:
- Use the Service for any unlawful purpose
- Create fake accounts or provide false information
- Interfere with or disrupt the Service
- Leave fraudulent reviews or ratings
- Resell purchased packages for profit
- Attempt to reverse-engineer the app or API
8. Reviews and Content
Users may leave reviews and ratings for Business Partners. Reviews must be honest, respectful, and based on actual experience. We reserve the right to remove reviews that violate these guidelines.
9. Intellectual Property
The Service, including its design, logos, text, graphics, and code, is the property of BitirFood and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.
10. Limitation of Liability
To the maximum extent permitted by law, BitirFood shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid through the Service in the 12 months preceding the claim.
BitirFood is not responsible for the quality, safety, or content of food provided by Business Partners. Any disputes regarding food quality should be directed to the Business Partner or reported to us.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee the availability, accuracy, or reliability of the Service.
12. Termination
We may terminate or suspend your account at any time for violation of these Terms. You may delete your account at any time through the app settings or by contacting support.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Turkey. Any disputes shall be resolved in the courts of Istanbul, Turkey.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use after changes constitutes acceptance.
